You can, but in order for the D40 to autofocus, it requires an AF-S or AF-I designation. If it's an AF lens, then you need to manually focus it on the D40. You don't mention the lens type, so impossible to say if it will autofocus or not.

The D70 kit lens is a 18-70 AFS and will work fine, for autofocuse to work on your new Nikon body the lens needs to be a Nikkor AF-S type. Many newer lenses are AF-S. Older lenses will work with manual focus.AF and AF-d lenses will meter just not focus.
