No. Warranty is for factory defects only. It does cover trade-in.
No, obviously you can't expect a shop to take back a used camera and give you a brand new camera. If you are unhappy with your D5000 you might well be unhappy with its replacement of similar price, since all cameras have their particular strong and weak points. Note very carefully what you dislike about the D5000 and how you would like your new camera to be different, then go to a shop at a quiet time and have a good long chat with a sympathetic salesman. You don't want to spend several hundred pounds/dollars then find yourself unhappy again.
