D90 has a sensor that's two generations newer. It's bigger, has more buttons instead of menu options and a lot more options (bracketing, inbody motor, CLS commander to name but a few)

Resolution: D40 = 6MP; D90 12.3MP
Flash Sync: D40 = 1/500, D90 = 1/200
Image Sensor Type: D40 = CCD, D90 = CMOS
Exposure Bracketing: D40 = No, D90 = Yes
HD Movie Mode: D40 = No, D90 = Yes

The lens and the skill of the photographer is what makes the picture. I've seen really nice pics from the D40 even though it's only a 6MP camera. The D90 has a lot of improvements though. If I had to choose though I'd go with a D5000 simply because it has AutoFP which is Nikon's feature to allow the camera to sync at it's maximum shutter speed 1/4000. Why they didn't include that as well as exposure bracketing on all their DSLR's is beyond me.

Another big difference: D90 has a focus motor allowing it to use any AF lens to autofocus.
The D40 requires AF-S or AF-I lenses to autofocus. On AF lenses, you will need to manually focus.

D90 is noticeably quieter at higher ISO settings than the D40.

D90 has dedicated buttons which makes changing settings easier.

In the hands of a good photographer and ISO setting of 200, both cameras will take excellent technical shots. The photographer will make the picture say something.
