I have been observing constellations with my Nikon "action"10x50 6.5° binoculars and i wanted to upgrade to a tripod binocular but i wanted to stay under $350.00 for the tripod and binoculars. Please i welcome comments recommendation experience.

Well here is a pair for $319 not counting tripod. Might have to break $350 to get the two

To support large binoculars well you will want a robust and quality tripod, don't be surprised if that's more expensive than the binoculars themselves. Manfrotto are well-regarded for a reason, and I believe most people favour trigger-grip ball heads over pan-and-tilt ones. Even better would be a specialist mount like a parallelogram mount, but this may blow your budget now.

If you're thinking of spending $350, I'd strongly urge you to consider a telescope rather than a larger binocular. I use my 10x50 binocular a lot, but my larger (15x70) binocular hardly at all, preferring to use a telescope instead. $350 will get you a nice 6- or 8-inch Dobsonian.
